Notice of Revised Procedure for Screening Requests for Oral Argument
Effective Monday, June 3, 2019, the Third District Court of Appeal will implement the following revised procedure for screening requests for oral argument.
When a party files a request for oral argument pursuant to Fla. R. App. P. 9.320, that request will be assigned to a panel of judges, who will review the case and either grant or deny the request for oral argument.
If the request is granted, oral argument will be set during the reviewing panel’s scheduled oral argument week. If the panel determines that the case should be decided without oral argument, an order denying the request shall issue and the case will be decided by the panel expeditiously.
This revision is intended to modify our current procedure, in which we automatically schedule oral argument when a request is made, subject to cancellation and removal from the oral argument calendar if the assigned panel determines that oral argument is unnecessary.
In order to fully implement this revised procedure, there will be no scheduled oral arguments for the months of June, July or August, with the exception of specially-scheduled oral arguments, if a particular case requires expedited resolution and the assigned panel determines that oral argument should be held.
